1. Agreement to Terms
By accessing or using Ogur's services, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access our services.
2. Services Description
Ogur provides technical services including:
- Linux and Windows System Administration
- Full Stack Web Development (React.js, Python)
- IoT Development (Arduino, Raspberry Pi)
- Security Audits
- WHM/cPanel Management
- Technical Outsourcing Solutions
3. Service Agreements
All services are subject to individual project agreements that specify:
- Project scope and deliverables
- Timeline and milestones
- Pricing and payment terms
- Intellectual property rights
The project agreement takes precedence over these general terms.
4. Payment Terms
4.1 Hourly Services
Hourly services are billed at €50/hour. Payment is due within 14 days of invoice date.
4.2 Project-Based Services
Project pricing will be specified in the project agreement. Payment terms may include:
- Upfront deposit (typically 30-50%)
- Milestone-based payments
- Final payment upon project completion
4.3 Payment Methods
We accept payment via bank transfer, PayPal, or other agreed-upon methods. Payment must be made in EUR unless otherwise agreed.
5. Intellectual Property
Upon full payment, intellectual property rights for custom-developed solutions transfer to the client, unless otherwise specified in the project agreement. We retain rights to:
- Proprietary tools and frameworks we developed
- Our methodology and processes
- Pre-existing code and libraries
6. Client Responsibilities
Clients agree to:
- Provide accurate information and requirements
- Respond promptly to requests for information
- Make timely payments as agreed
- Provide necessary access and credentials
- Ensure compliance with applicable laws
7. Limitation of Liability
Ogur's liability is limited to the total amount paid for the specific service. We are not liable for:
- Indirect, incidental, or consequential damages
- Loss of data or profits
- Issues arising from third-party software or services
- Client's failure to follow our recommendations
8. Warranties
We provide services with professional standards. However:
- We do not guarantee 100% uptime (except where specified in service level agreements)
- Third-party software and services are provided "as-is"
- We comply with security best practices but cannot guarantee absolute security
9. Cancellation & Refunds
9.1 Project Cancellation
Projects may be cancelled by either party with written notice. For cancelled projects:
- Work completed up to cancellation date is payable
- Deposits are non-refundable if cancellation is client-initiated
- We may retain project files until full payment is received
9.2 Refund Policy
Refunds are considered on a case-by-case basis and are not guaranteed. We will work with clients to resolve issues before considering refunds.
10. Confidentiality
We maintain strict confidentiality of client information and project details. We will not disclose client information to third parties without consent, except as required by law.
11. Support & Maintenance
Unless included in a support agreement:
- Post-project support is billed at standard hourly rates
- Response time is typically within 24-48 hours
- Emergency support may be available at premium rates
12. Force Majeure
We are not liable for delays or failures due to circumstances beyond our reasonable control, including natural disasters, internet outages, or third-party service failures.
13. Modifications to Terms
We reserve the right to modify these terms at any time. Continued use of our services after changes constitutes acceptance of new terms.
14. Governing Law
These terms are governed by the laws of Madagascar. Any disputes will be resolved through negotiation, and if necessary, through appropriate legal channels.
